Policy and Procedure

Our e-mail marketing campaigns comply strictly with the following FTC guidelines per The CAN-SPAM Act of 2003:

  • False or misleading header information is prohibited
  • Deceptive subject lines are prohibited
  • Senders valid physical address is also required
  • Emails must provide a return email address or another Internet-based response mechanism to allow a recipient to opt out of future email messages to that email address
  • By law, no emails may be sent after 10 business days of a request to opt-out, however, but we will make every attempt to remove the recipient within 48 hours of the request.

We will be using data obtained in the following fashion:

  • Newsletter Signups
  • Registration Signups
  • Purchase Pages
  • List Management
  • Data Overlays
  • Self-Reported Data
    (Compliant with the 2003 CAN SPAM Act)

Data – Deliverability:

  • Our sender is white listed with all ISP’s which allows us to penetrate inboxes
  • We guarantee deliverability. If a client orders 1MM records, we will successfully deliver 1MM records
  • Our deliverability rate is 85-95% but will re-mail and/or over mail to ensure the order is fulfilled

Unsubscribe/Opt Out Link:

Email is unlike other mediums because of how directly and personally it communicates to the client. In order to promote your offers, while maintaining Can-Spam compliance, the following must be done:

  • All client creatives must have a postal address as well as an individual opt out link the client can contact directly.
  • This is in addition to the opt-out link and address that the mailer must provide
  • All opt-outs are handled immediately and processed out of all servers within 48 hours

 

 

TERMS & CONDITIONS:
For services and media there is a no return policy--only a replacement policy. If a database is bad or not matching an order it will be replaced. No refunds or charge backs are warranted because we have ordered an exclusive product that is non-returnable. No refund or exchanges will be offered. ONLY REPLACEMENTS WILL BE PROVIDED REGARDLESS OF CIRCUMSTANCES OR SEPARATE ARRANGEMENTS MADE OUTSIDE OF THESE TERMS AND CONDITIONS. We strive for 100% customer satisfaction; if any issues arise please contact us directly.

There are no guarantees of success for any marketing campaigns. Like any form of traditional advertisement, marketing has its successes and failures due to marketing conditions and other factors. We shall not be liable for any unsuccessful marketing campaigns. The deliverability of any message is subject to numerous factors and many of those factors are outside our control. We are agreeing to provide a service to broadcast your message to our lists of subscribers. Additionally, it is understood in regard to any data that we provide, that because we rely on the truthfulness of the persons providing the information contained in our database(s) and/or list(s) of recipients, we cannot guarantee that all of the information is 100% accurate and can only guarantee that the information was reported to us as accurate at the time it was collected. However, we do promise that any inaccuracies in our database(s) and/or list(s) of recipients will be corrected or deleted when discovered. All of your marketing campaigns must be in full compliance with all state and federal laws.
